These Terms of Service ("Terms") govern your use of our website and your booking and receipt of massage and spa services at Zen Massage Therapy LLC ("we," "us," or "our"). By booking an appointment, purchasing a service, or using our website, you agree to be legally bound by these Terms.
1. Compliance with State and Federal Law & Right to Refuse Service
Zen Massage Therapy LLC strictly adheres to the regulations set forth by the Oregon Board of Massage Therapists (OBMT) and all applicable local, state, and federal laws. We maintain a strictly professional, therapeutic environment.
• Right to Refuse Service: We reserve the right to refuse service to anyone at any time, for any reason permitted by law.
• Zero Tolerance Policy: Any inappropriate behavior, sexual harassment, intoxication, or requests that violate OBMT guidelines or the law will result in the immediate termination of your session with no refund. Law enforcement will be contacted if necessary.
2. Medical Disclosures & Intake Waivers
Your health and safety are our top priorities.
• Required Disclosure: Prior to your session, you must disclose all past surgeries, injuries, medications, and current medical conditions. This allows our therapists to safely accommodate you and avoid specific areas if necessary.
• Liability Waiver: All clients are required to read and sign a liability waiver and intake form before their massage or spa session begins. Failure to complete this documentation will result in the cancellation of your appointment.
3. Minors
Clients under the age of 18 must be accompanied by a parent or legal guardian for the entire duration of the appointment. The parent or guardian must also sign the intake form and liability waiver on behalf of the minor prior to the start of the session.
4. Therapist Gender Preferences
We do our best to accommodate your preference for a male or female massage therapist.
• Availability: If your preferred gender is unavailable at your scheduled time, you may choose to see an available therapist of a different gender.
• Cancellations Due to Preference: If you decline the available therapist and choose not to proceed with the appointment, your appointment will be canceled.
• Refund Policy on Preference Cancellations: If this cancellation occurs close to your appointment time—especially on weekends (Friday through Sunday)—you may only be eligible for a partial refund, as that time slot was reserved exclusively for you and prevented another client from booking.
5. Arrival, Lateness, and Wait Times
We understand that traffic and unforeseen circumstances happen, but maintaining our schedule is vital for all our guests.
• Client Lateness: We grant a 5-minute grace period for late arrivals. If you are more than 5 minutes late, your session time may be shortened to accommodate the next guest, and you will still be charged for the full session.
• Spa Delays: Because we allow grace periods, there may occasionally be a wait time of up to 15 minutes before your session begins if the previous client arrived late. We appreciate your patience and understanding.
6. Cancellations & Rescheduling
• Rescheduling Limit: Appointments may only be changed or rescheduled one time.
• 48-Hour Notice: We strictly enforce our rescheduling policy, especially if the request is made with less than 48 hours' notice. Repeated rescheduling or cancellations with less than 48 hours' notice may result in the forfeiture of your deposit or full payment.
7. Third-Party Vouchers (Groupon, etc.)
If you have purchased a ticket, voucher, or coupon from a third-party vendor (such as Groupon):
• Valid Days: Third-party vouchers are honored strictly from Monday through Thursday. They cannot be redeemed on Fridays, Saturdays, Sundays, or major holidays.
• Standard Policies Apply: All other cancellation, lateness, and conduct policies outlined in these Terms apply to third-party voucher holders.
8. Customer Satisfaction
We want you to have a relaxing and healing experience.
• Immediate Resolution: If you are unhappy with your service (e.g., the pressure is too hard or too light, the room is too cold), you must inform your therapist or our front desk staff immediately during the session or right after it concludes.
• If you communicate the issue to us right away, we will do everything in our power to fix it and ensure you leave satisfied. We cannot address or refund complaints made days after the service has been completed.
9. Fake Reviews & Defamation
We value honest feedback and constructive criticism. However, we have a zero-tolerance policy for malicious attacks on our business.
• Strict Legal Action: If an individual posts fake, fabricated, or intentionally defamatory reviews online, Zen Massage Therapy LLC will take immediate and aggressive legal action. We reserve the right to pursue all available legal and equitable remedies under state and federal law, including lawsuits for defamation, libel, loss of revenue, and damages, against anyone who attempts to unlawfully harm our business reputation.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon and applicable federal laws of the United States, without regard to its conflict of law provisions.
